Terms of Service

1. Service Overview
KIXDAY is an online sneaker battle app by ShoeTracker.ai (the “App”), owned and operated by ADS Delivery OOD, a Bulgarian limited liability company incorporated under the laws of Bulgaria, company number 208549000, with its registered seat at 192A Cherni Vrah Blvd., 1407 Sofia, Bulgaria (“ADS”, “we”, “us” or “our”).
The App lets you photograph or upload a still image of your sneaker, have the background removed, name the pair yourself, choose a public display handle and create a one-on-one “battle” link. A friend answers with their own pair, and anyone holding the link can vote for one shoe. Battles last 24 hours. Results update a per-pair Card (wins, losses and a heat score) and a public Locker page for your handle. The App also offers ON FEET, a daily check-in where you mark which pair you are wearing that day. Features may be added, renamed, modified, limited or discontinued from time to time.
KIXDAY does not sell products and is not a marketplace, sneaker authenticator or appraisal service. ADS is not a party to any purchase, sale, return, refund or warranty transaction between users or between a user and any third party.
KIXDAY is currently free to use and offers no purchases, subscriptions or paid digital services. If paid features are introduced in the future, separate terms will apply to them and will be presented before any payment. ADS may apply usage allowances, feature limits or eligibility conditions as displayed through the App.
By accessing or using the App, including by voting through a battle link, you agree to these Terms of Service (“Terms”) and the Community Rules, and acknowledge the Privacy Policy. Where an affirmative acceptance control is presented, you also confirm your agreement by selecting that control.
2. Eligibility, Age and Access
You may use the App only if you are at least 16 years old and are legally permitted to do so. Where applicable law requires a higher age to consent independently to the use of online services or the processing of personal data, you must satisfy that requirement or have any required authorization from a parent or legal guardian. The App relies on the information and declarations provided by users and does not independently verify age.
Before creating a battle, answering a battle or using ON FEET, you will be asked to confirm that you are 16 or older. Voting through a battle link does not require that confirmation or an account, but voters are also bound by these Terms and the Community Rules.
KIXDAY does not offer user accounts in this version. When you create content, your browser stores a private random creator key that lets you delete your own battles and Cards from that browser. If you clear your browser data or change device, that key may be lost; you can still request deletion by email as described in Section 11. You are responsible for keeping your device and browser secure.
3. User Content, Creative Inputs and License to ADS
Certain features allow you to upload or capture a still sneaker image and provide creative inputs, including a public display handle and a sneaker brand or model name for your pair.
You retain ownership of the content you upload, capture, submit or create through the App (“User Content”). By providing User Content, you confirm that:
- you own the User Content or have all necessary rights and permissions to use it;
- the User Content does not infringe copyright, trademark, privacy, publicity or other third-party rights;
- the User Content is not unlawful, harmful, misleading or otherwise prohibited; and
- the User Content complies with these Terms, including the Acceptable Use section and the Community Rules.
By providing User Content, you grant ADS a limited, non-exclusive, worldwide and royalty-free license to host, process, crop, isolate, remove backgrounds from, transform, render, reproduce, display, transmit, cache and make available that User Content solely as reasonably necessary to operate the App, generate the requested experience, provide the selected feature, maintain App safety and integrity, and enable sharing selected by you.
Where you use a link-accessible or public feature, including battles, Cards, Locker pages and ON FEET, the licence includes making the relevant User Content and generated experience available through that feature and through third-party sharing channels. The licence does not transfer ownership of your User Content to ADS.
KIXDAY does not independently verify ownership, copyright status, trademark rights, permissions, sneaker authenticity, sneaker ownership, originality or the accuracy of user-provided product descriptions. You remain responsible for the accuracy and lawfulness of all content you submit.
The App does not algorithmically identify, authenticate or label footwear from an uploaded or captured image. Any sneaker brand or model name is typed by the user. Cards, heat scores and similar information are community-based indicators and do not constitute product verification, proof of ownership or authentication.
4. Camera, Image Processing and Media Retention
The App is designed for still sneaker images. It does not use continuous or background camera recording, microphone access, audio recording, facial recognition, biometric identification or identity verification. Where a camera option is offered, it captures a still image selected by the user. Photograph the shoe, not people.
Uploaded or captured images may be screened by automated image-safety tools before or after processing. These tools may not identify every category of unsuitable or prohibited content. Handles and pair names may not be automatically screened.
Images are processed to remove the background and produce a sneaker cut-out. This is done by a specialist third-party processor, as described in the Privacy Policy. ADS requests deletion of the provider-side processing copy right after processing, but the derived cut-out and related records are retained where necessary to operate the relevant feature.
ADS does not currently use uploaded images, captured images or User Content to train, fine-tune or otherwise develop AI or machine-learning models. If ADS intends to introduce such use in the future, it will do so only after providing appropriate prior notice, updating the applicable privacy disclosures, and implementing any consent or other lawful basis required under applicable law before such use begins.
Different categories of content are retained for different periods depending on the relevant feature. Retention periods for battles, Cards, Locker pages, ON FEET records, votes and related media are described in the Privacy Policy.
Copies already shared, downloaded, forwarded, screenshotted or cached by recipients or third-party platforms remain outside ADS’s control, and ADS is not responsible for the subsequent processing of those copies by recipients or third-party platforms.
5. Sneaker Descriptions, Brand References and Third-Party Rights
Users name their own pairs. Brand names, model names and other descriptive references are provided by users and are not independently verified, endorsed or generated through image recognition by KIXDAY.
User-provided brand and model references may appear in battles, Cards, Locker pages, ON FEET check-ins, share videos, preview images and link previews.
All trademarks, brand names, logos, product names and other third-party identifiers remain the property of their respective owners. Unless expressly stated otherwise, ADS, ShoeTracker.ai and KIXDAY are not affiliated with, sponsored by, endorsed by, approved by or officially connected with any shoe brand, product owner or other rights holder.
Brand, model and product references are used for descriptive purposes only. They do not imply affiliation, endorsement, sponsorship, partnership, approval, authenticity verification, product availability, purchase confirmation or proof of ownership.
Users are responsible for ensuring that any brand names, model names, descriptions, logos, images or other content they submit are accurate, lawful and do not infringe third-party rights. Users may not submit counterfeit marks, misleading brand references or content that falsely suggests official affiliation, endorsement, sponsorship, partnership or approval.
ADS may remove, restrict or disable access to content containing third-party brand or product references where reasonably necessary for legal compliance, a valid rights-holder complaint, App integrity, user reports or suspected misuse. 6. Share Videos, Public Links and External Platforms
The App generates a short share video (about nine seconds, without audio) and a preview image on your device from the sneaker cut-outs. Nothing is posted automatically. ADS does not publish content on your behalf; you choose whether and where to share, for example through your device’s share sheet, WhatsApp or Instagram. Sharing is performed at the user’s discretion and responsibility.
Generated outputs may include stylized, illustrative or imperfect visual elements. They are creative visualizations only and should not be interpreted as accurate representations of real-world products, authenticity, ownership, brand affiliation, endorsement or real events.
Battles are unlisted links and are not shown in a public feed in this version. However, anyone who holds a battle link can open it and vote, and a Locker page is public for the relevant handle. When a link is shared, the App makes a preview image or sneaker cut-out available through a publicly accessible URL so that a messaging or social-media platform can display a preview before the link is opened. The relevant third-party platform may independently store or cache that preview.
Once content is shared, downloaded or accessed through a shared link, it is also subject to the terms, policies and technical rules of the relevant third-party service. Content may be viewed, copied, forwarded, reposted, screenshotted, edited, redistributed or otherwise used outside KIXDAY’s control.
ADS is not responsible for further sharing, redistribution, modification, publication, removal, blocking or treatment of shared content by recipients or third-party platforms. Removing content from KIXDAY cannot recall copies already distributed, downloaded, screenshotted or cached elsewhere.
7. Battles, Votes, Cards, Locker and ON FEET
A battle is a one-on-one match between two pairs. Anyone holding the battle link may vote for one shoe without an account. Each browser or device may cast one vote per battle. Voting closes when the 24-hour battle period ends, after which the result is final.
ADS applies technical and anti-abuse measures to votes, including a random identifier stored in the voter’s browser and a salted one-way hash of the network address, as described in the Privacy Policy. Such measures do not verify a participant’s real-world identity and may not prevent every repeated, manipulated or invalid interaction. ADS may disregard, remove or reverse votes and results that it reasonably believes are manipulated or invalid.
Votes, results, win and loss records, heat scores and Locker pages are provided for entertainment and engagement only and are not professional evaluations or guarantees of value, quality, authenticity, condition or popularity.
ON FEET allows a user to self-report which pair they are wearing on a particular day and to build a streak. A still photo is optional. ON FEET information is self-reported, is not independently verified by ADS, and does not constitute proof of identity, ownership, purchase, authenticity or actual wear.
Users should not include private, confidential or sensitive personal information in handles, pair names or any field that may be displayed publicly or through a shared link.
Heat scores, streaks, records and other digital indicators are entertainment features only. They have no cash value, are not money, stored value, securities or property, cannot be redeemed for cash from ADS, and may be changed, reset, limited, revoked or discontinued.
The App may impose usage allowances, rate limits and anti-abuse controls. Limits may apply by browser, device, identifier, network address or another reasonable technical basis and may vary by feature. Attempting to circumvent such limits or controls is prohibited.
8. Acceptable Use and Content Moderation
Users may not upload, submit, generate, distribute, share or otherwise make available through the App content that:
- violates applicable law or third-party rights;
- infringes copyright, trademark, privacy, publicity or other intellectual-property or personal rights;
- contains harmful, abusive, hateful, discriminatory, vulgar, violent, deceptive, misleading or unlawful material, including in a handle or pair name;
- impersonates another person or entity, misrepresents identity, affiliation, sponsorship or approval, or falsely suggests official status;
- contains nudity or sexualized content, illegal products or services, or references to unlawful activity;
- depicts people, faces, bodies or minors;
- includes identity documents, payment cards, addresses, private documents, personal data or other sensitive material;
- includes infringing, counterfeit, deceptive or misleading brand references, logos or marks, or offers counterfeit goods for sale; or
- is otherwise harmful, unsafe, unsuitable or inconsistent with these Terms or the Community Rules.
Users may not misuse the App or attempt to bypass usage limits, security measures, voting safeguards, rate limits, access controls or other anti-abuse protections through bots, scripts, automated tools, vote farming, multiple browsers or devices, or other circumvention methods.
Automated moderation is not a substitute for user responsibility and may not detect every violation. ADS may review, remove, restrict or disable access to content, battle links, Cards, Locker pages, votes, results or related information where reasonably necessary for safety, legal compliance, App integrity, valid rights-holder complaints, user reports, suspected misuse, voting manipulation, policy violations or enforcement of these Terms.
Users may report inappropriate, unlawful or infringing content through the Report button on any battle or at info@shoetracker.ai. Additional information is available on the Copyright & Takedown page.
ADS may block the creation of further content from a browser, device or network address, in appropriate circumstances, where a user repeatedly infringes third-party copyrights.
9. Data Processing and Privacy
ADS may process personal data, User Content and technical information as necessary to provide, operate, secure, maintain and improve the App, subject to these Terms, the Privacy Policy and applicable law.
Depending on the feature used, this information may include uploaded sneaker images and cut-outs, handles and pair names, battle records, votes, Card and Locker records, ON FEET check-ins, browser identifiers, a salted hash of the network address, technical logs, and usage and security information.
The App uses cookies and browser storage for essential functionality, including the creator key, the voter identifier and abuse prevention. Further information about the purposes and legal bases of processing, recipients and service providers, retention periods, international transfers, user rights and deletion procedures is provided in the Privacy Policy.
10. Third-Party Services
The App relies on third-party providers for services such as hosting, infrastructure, storage, databases, security, AI-assisted image processing and moderation, and external sharing or social-media functionality.
Third-party services may experience failures, interruptions, delays, inaccuracies, removals, blocking, display changes or other technical issues outside ADS’s reasonable control. ADS does not guarantee the continuous availability or performance of any third-party service.
Where users access or interact directly with a third-party service, their use may also be subject to that provider’s own terms, privacy policy and technical requirements.
Information about providers that process personal data is provided in the Privacy Policy. Providers may be added, replaced or removed as the App develops.
11. Deleting Your Content
A creator may delete their own battles and Cards from the browser that holds their creator key. A creator who no longer has access to that key may request deletion by emailing info@shoetracker.ai with the relevant battle link. Because the App has no accounts, ADS may ask for information reasonably necessary to confirm that you created the content before deleting it, in order to protect other users.
Content also expires automatically under the retention periods described in the Privacy Policy. ADS may retain limited records where reasonably required for legal compliance, security, fraud prevention, dispute resolution or enforcement of these Terms.
12. ADS and App Intellectual Property
Except for User Content and third-party materials, the App and the software, interface, templates, effects, creative assets, designs, text, graphics, logos, rendering logic, technology and other materials made available by ADS are owned by or licensed to ADS and are protected by applicable intellectual-property laws.
Subject to these Terms, ADS grants users a limited, non-exclusive, non-transferable and revocable right to access and use the App and to use, download and share generated content as delivered through the App for personal, social or other permitted purposes. This right does not transfer ownership of any App material to the user.
Except as necessary to use the App and share generated content as expressly permitted by these Terms, users may not copy, extract, reproduce, distribute, sell, sublicense, scrape, reverse engineer, decompile, modify, create derivative works from or otherwise exploit the App, its templates, assets, software or underlying components.
Users may not use the KIXDAY or ShoeTracker.ai names, marks, logos, trade names, domain names, branding, visual identity or confusingly similar identifiers without prior written permission, except for ordinary, accurate and non-misleading references to KIXDAY and the voluntary sharing of generated content as permitted by these Terms. No such use may falsely suggest affiliation, endorsement, sponsorship, partnership, official status or approval.
Nothing in these Terms waives ADS’s rights or grants any licence to use ADS marks or App materials beyond the limited rights expressly provided above.
13. Limitation of Liability
The App is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, ADS does not guarantee that the App, generated content, votes, results, scores or third-party services will always be available, uninterrupted, accurate, unique, error-free or suitable for a particular purpose.
ADS is not responsible for matters outside its reasonable control, including:
- product availability, purchases, sales, refunds, returns, warranties or other dealings between users or with third parties;
- User Content, sneaker images, brand or model references or other information submitted by users;
- copying, forwarding, reposting, modification, redistribution or other use of generated or shared content by users, recipients or external platforms;
- failures, interruptions, blocking, removal, display changes or other actions by third-party services; or
- loss of views, engagement, votes, wins, streaks, traffic or other social-media results.
To the maximum extent permitted by applicable law, ADS will not be liable for indirect, incidental, special or consequential loss arising from the use of, or inability to use, the App.
Nothing in these Terms excludes or limits any liability or mandatory consumer right that cannot lawfully be excluded or limited, including liability for fraud, willful misconduct, gross negligence, death or personal injury where applicable.
14. User Responsibility and Indemnity
You are responsible for your User Content, your use of the App and your compliance with these Terms.
To the extent permitted by applicable law, you agree to indemnify and hold ADS harmless from third-party claims, losses, liabilities and reasonable legal costs arising directly from:
- unlawful or infringing User Content submitted by you;
- your infringement of copyright, trademark, privacy, publicity or other third-party rights; or
- your intentional or material misuse of the App.
This indemnity does not apply to the extent that a claim or loss was caused by ADS or where such indemnity is prohibited or limited by applicable consumer law.
15. Service Availability
ADS may update, modify, suspend, limit or discontinue the App or any feature from time to time for legitimate reasons, including product development, maintenance, security, legal compliance, technical changes, changes to third-party services or improvements to the user experience.
Continuous or uninterrupted availability of the App, any battle, Card, Locker page, ON FEET check-in, share link or other functionality is not guaranteed.
Where a change materially and adversely affects a user’s access to or use of the App, ADS will provide any notice, information or remedies required by applicable law. Nothing in this section limits any mandatory consumer rights.
16. Changes to the Terms, Suspension and Termination
ADS may update these Terms from time to time for legitimate legal, security, technical, operational or product-related reasons. Updated Terms will be made available through the App and will state their effective date.
Where changes are material, ADS will provide any notice or request for acceptance required by applicable law. Continued use after the effective date constitutes acceptance only to the extent permitted by law.
ADS may suspend, restrict or terminate access to the App, or remove or restrict content, where a user violates these Terms or the Community Rules, infringes third-party rights, misuses the App, manipulates votes or other interactions, bypasses technical controls, threatens App safety or integrity, or where action is reasonably necessary for legal compliance or security.
Immediate action may be taken where it is reasonably necessary to prevent harm, address a security risk, comply with law or respond to a valid rights-holder complaint. Where required by law and reasonably possible, ADS will provide notice of the action and the principal reason for it.
Users may stop using the App at any time and may delete or request deletion of their content as described in Section 11 and the Privacy Policy, subject to applicable retention requirements.
Provisions that by their nature should continue after termination, including intellectual-property, permitted-retention, limitation-of-liability and dispute-resolution provisions, will remain in effect.
17. Governing Law and Consumer Rights
These Terms are governed by the laws of Bulgaria. However, this choice of law does not deprive consumers of any mandatory protections available under the laws of their country or state of habitual residence.
Any dispute arising from or relating to these Terms will be subject to the jurisdiction of the competent courts in Bulgaria, except where mandatory consumer-protection, jurisdiction or conflict-of-law rules allow or require proceedings in another court.
Nothing in these Terms limits any mandatory consumer rights or remedies that cannot lawfully be excluded or restricted.

Questions concerning these Terms, reports of inappropriate, unlawful or infringing content, rights-holder complaints, and privacy or data-rights requests may be submitted through the Report button on any battle or by email to info@shoetracker.ai.
